The primary responsibilities of the Trademark Paralegal are to administrate all domestic trademark matters for all coalitions through their Delaware Holding Companies.
Qualifications !
Education/Experience:
5 years of related professional experience
Associates or Bachelor of Arts Degree (Bachelor of Arts Degree preferred)
Paralegal certification
Minimum of five (5) years experience with trademark law
Skills:
Ability to work as part of a team careful attention to detail
Good analytical skills
Good oral and written communication skills
Ability to work independently yet seek guidance as appropriate
Ability to research legal issues
Ability to deal effectively with members of business units and outside counsel
Ability to work under pressure with multiple deadlines

Knowledge of Microsoft Word, Excel and Access
Knowledge of Web TMS or comparable trademark database
Knowledge of Saegis or comparable on-line tradema! rk search tool
Knowledge of applicable trademark regu! lations, procedures and electronic filing system of the United States Patent and Trademark office
Willingness to adapt to changing circumstances
Demonstrate resourcefulness, responsiveness and strong work ethic
Knowledge of foreign languages is a plus.

Requires minimal travel to other company locations
Key Responsibilities
1. TRADEMARK CLEARANCE: conducts Saegis and internet searches to determine whether proposed trademarks are available; orders and analyzes common law searches on proposed trademarks; investigates third party rights and identify options for resolving any conflicts; recommends to Assistant General Counsel or Senior Attorney whether trademarks are available
2. TRADEMARK REGISTRATION: Under supervision of Assistant General Counsel or Senior Attorney, prepares and files trademark applications; drafts responses to office actions issued by United States P! atent and Trademark Office trademark examiners; investigate third party rights and identify options for resolving any conflicts defend applications against oppositions; provides required proof of use documents obtained from business groups
3. TRADEMARK MAINTENANCE: . Under supervision of Assistant General Counsel or Senior Attorney, prepares and files affidavits; obtains and files evidence; prepares and files renewal applications; pays maintenance fees; files other documents necessary to maintain trademark registrations; reclassifies registrations when required by changes in laws; prepares and files assignments to document changes of ownership; amends form of trademark when desirable or necessary
4. TRADEMARK ENFORCEMENT: Reviews Official Gazette weekly to ID 3rd-party applications or supplemental registrations that might violate our trademark rights; reviews trademark notices daily to ID 3rd-party applications that might violate our trademar! k rights; identifies legal bases for challenging identified application! s or supplemental registrations; determines whether we have required evidence to oppose identified applications or supplemental registrations; recommends whether to oppose identified applications; instructs outside counsel to oppose applications that attorneys determine should be opposed; responds to Customs Inspector inquiries regarding suspect product at U.S. or foreign borders
5. TRADEMARK AGREEMENTS: reviews and comments on consent, settlement, and co-existence agreements; drafts consent, settlement, and co-existence agreements
6. TRADEMARK LICENSING: verifies existence of trademark rights desired to be licensed; conducts clearance searches needed for trademark licenses; obtain registrations needed for trademark licenses; prepares trademark schedules for license agreements; drafts customs authorization letters needed by licensees or their contract manufacturers
7. OUTSIDE COUNSEL: approves outside counsel, investigator, an! d other vendor invoices and code them for accounting; establishes and maintains relationships with outside counsel in multiple foreign jurisdictions; investigates potential firms and recommend who to hire
8. Web TMS DATABASE: maintains integrity of information in database relating to ownership rights and due dates; prepares Web TMS reports; searches information in Web TMS database to answer questions; verifies details and due dates for each case record inherited from other firms' systems; runs reports for business management information and decisions
9. GENERAL: responsible for answering questions from Corporate Legal Department and from operating divisions; keeps up with product developments in the company and the industry; keeps up with changes in trademark law throughout the world; researches and compiles information pertaining to U.S. and international trademark rights, procedural matters, and case law; establishes correspondence and tele! phone conferences with clients, outside counsel, opposing counsel, and ! trademark examiner; reviews products, advertising and packaging to ensure proper use of trademarks; prepares status summary reports for clients' trademarks; provides client training and education on specific trademark issues; performs
other projects as assigned
10. DEADLINE MONITORING: responsible for monitoring trademark prosecution and renewal deadlines and taking the necessary actions in time to meet those deadlines.
